This website is operated by Dibbly Inc. Throughout the site, the terms “we”, “us” and “our” refer to Dibbly Inc. Dibbly Inc. offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Our Freelancers offer our customers a wide range of content creation options, including but not limited to:

  • Narration and voice over services

Customers who are interested in having content created that isn’t part of our current offerings can email sales@dibbly.com as our dedicated Sales Agents may be able to accommodate them through custom orders.

Dibbly | The Urban Writers guarantees that all freelance content creators have been thoroughly screened, vetted, and tested against our stringent quality standards. However, customers are encouraged to browse through the freelancers on our Platform and to communicate with them ahead of time to ensure that the desired working relationship is a good fit for everyone involved.

Furthermore, Dibbly | The Urban Writers does not make any guarantees in regards to the availability of these products or the freelancers who create them. Notwithstanding any other issues with contracting, some products may sporadically be unavailable or may have waiting times associated with their assignment.

SECTION 6 - OUT OF SCOPE WORK

Out of scope work refers to tasks that are not covered by the services provided by Dibbly | The Urban Writers. Our company's services are exclusively available for purchase through project orders or add-on requests from Customer Success. Therefore, out of scope work is limited to tasks that clearly fall outside of the range of services we offer. It is work agreed upon between the customer and freelancer for services the customer needs and the freelancer is able to provide, but are not within the scope of services provided by our Platform.

By engaging in out of scope work, the customer and freelancer enter into a contract independent of Dibbly | The Urban Writers. Dibbly | The Urban Writers is not liable or responsible for any issues that may arise from out of scope work. While we are willing to offer assistance, we cannot directly involve ourselves in the contractual agreements, quality reviews, or changes to the scope of work between the customer and freelancer.

In cases where a freelancer is unable to fulfill a contract for out of scope work, Dibbly | The Urban Writers may intervene to offer a credit to the customer or source a new freelancer to complete the contract. Customers and freelancers are encouraged to initiate out of scope work with a discussion over a call to clarify expectations and plans. During this call, it is recommended that total hours of work and final deliverables are confirmed before commencing the out of scope work. If the freelancer completes the work in fewer hours than the hours allotted for the out of scope work, they must inform the customer of this before the order is fulfilled. The customer can contact the Customer Success team at support@dibbly.com to request a credit for unused hours, which can be applied toward any new order on the Dibbly | The Urban Writers Platform or toward additional out of scope work with the freelancer. This credit must be requested before the project's fulfillment.

Out of scope work must not include any services provided by Dibbly | The Urban Writers; customers must purchase our services through project orders or add-on requests from Customer Success. It is essential that out of scope work involves services that genuinely fall beyond our standard offerings.

Below, we will outline possible examples of what may constitute out of scope work and how this differentiates from the services we provide and the standard work included in our offerings.

Out of Scope Work Examples:

  • Typing jobs
  • Transcription jobs
  • Design work not offered by Dibbly | The Urban Writers, e.g., logo design, slide deck creation, design and layout for coffee table books
  • Substantive editing
  • Expert consultation services (e.g., Subject Matter Experts providing expert opinions and deep fact-checking)
  • In-depth research

Distinguishing In-Depth Research from Regular Research

Regular or Basic Research:

  • Involves general information, facts, and background knowledge directly related to the project topic publicly available on the internet.
  • Includes understanding the basic setting, characters, historical context, and key themes without requiring expert-level knowledge.
  • Involves using accessible sources that contain information that is easily verifiable, i.e. information that does not require special knowledge to distinguish as false or factual
  • Examples include: researching names, places, dates, major events, basic facts such as symptoms of an illness, popular poses for a yoga routine or different types of bank accounts for young adults looking to save for the future.
  • Does not involve special interviews, digging into academic sources or inaccessible information, e.g. information behind a paywall.

In-Depth Research:

  • Accessing specialized resources that require special knowledge like legal documents or , academic articles that require the researcher to have knowledge of the academic field it was written in beyond laymen's knowledge.
  • Analyzing non-standard resources, e.g., maps, difficult to decipher handwritten sources or sources that require translation.
  • Expert analysis of resources e.g. analysing art to obtain insight or information.
  • Information obtained from reading research studies in their original form when online articles explaining the study are not available or insufficient.
  • Information obtained through consulting third parties (e.g. conducting interviews).
  • Information obtained through resources that are difficult to obtain or access, including but not limited to:
    • Resources requiring access to libraries.
    • Resources on outdated media.
    • Examples can include: microfiches, rare footage, CDs, cassettes, vinyls or tapes, rare audio or video recordings, archives, historical documents, or records, including but not limited to court, personal, medical, financial and birth/death records.
  • Researching beyond the initial topic scope to explore alternative angles and ideas not outlined in requirements, e.g. In a book centered on the keto diet, the customer requests additional insight into the alkaline diet and it differs from keto, after the writer has already conducted all research requested by the outline and started the writing process.
  • Analyzing raw data to draw new conclusions.
  • Requiring specific expertise, e.g., medical or academic backgrounds or degrees.
  • Visiting relevant locations
  • Research that requires the analysis of complex articles on finance and/or tech for projects that DO NOT fall in the Fintech niche.
  • Reviewing unusually long resources like entire books, listening to lengthy audio recordings, watching extensive footage, attending lectures, inspecting extensive survey results, reviewing statistical analyses.
  • Conducting hands-on research, experiments, or fieldwork, which includes but is not limited to:
    • the collection of raw data
    • drawing up research studies
    • developing and conducting surveys
    • developing and conducting experiments
    • systematic reviews

    Substantive Editing

    • Involves detailed editing for structure, content, and language.
    • Includes rewriting and reorganizing content for clarity, coherence and the logical flow of arguments.
    • Focuses on improving the overall quality and effectiveness of the writing.
    • May involve significant changes to the text, such as adding or removing sections.
    • Editors may suggest changes to the title, language, and style to enhance the overall quality of the writing
    • Editors may provide comments for consideration or request clarifications without altering the core argument.
    • Substantive editors are often subject matter experts in the specific field of the manuscript and have a thorough understanding of specialized language.
    • Substantive Editing involves detailed corrections and improvements to the content, structure, and language of the text, whereas a Developmental Review (the closest editing package offered by Dibbly | The Urban Writers to substantive editing) primarily focuses on the organization, clarity, and coherence of the writing, especially in terms of form and structure without making tracked changes or revisions.

    SECTION 7 - EXCLUSIVE DIBBLY MARKETPLACE SERVICES

    By purchasing our pre-written eBooks, you acknowledge and agree to the following terms:

    1. No Refunds: Once an order for a pre-written eBook is delivered, it is non-refundable. We encourage you to thoroughly review the sample chapter and book description before making a purchase. 
    2. No Modifications: The content of the pre-written eBooks is final and cannot be altered or modified by Dibbly Inc. Customers are responsible for ensuring that the content meets their specific needs prior to purchase. Once the purchase is made, customers hold the rights to the content and may modify it at their own discretion.
    3. Additional Services: Customers may request additional content to be added to their pre-written eBooks at an additional fee. Please contact support should you require these services.
    4. Project Transfer: Once the invoice is paid, the project(s) containing the purchased book(s) will be transferred into the customer's account on the Dibbly Platform.
    5. Limitation of Liability: Dibbly Inc. shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the eBooks purchased. Customers are responsible for verifying that the eBooks comply with any regulations or standards relevant to their intended use, including but not limited to legal, educational, and industry requirements. It is the customer's responsibility to ensure that the content aligns with their specific needs and obligations.
    6. Changes to Terms: Dibbly Inc. reserves the right to modify these terms at any time without prior notice. It is the customer's responsibility to review the terms periodically for updates.

    SECTION 8 - THIRD-PARTY PUBLISHERS

    Dibbly | The Urban Writers does not take responsibility for any difficulties or problems that customers may encounter with Third-Party Publishers like Amazon KDP. It is the customer’s responsibility to register their copyright over content purchased from us if they wish to publish through a Third-Party Publisher that requires copyright to be registered as is the case with Amazon KDP.

    Furthermore, it is the customer’s responsibility to familiarize themselves with the rules and guidelines of any Third-Party Publishers which they may want to make use of before commissioning a work through our Platform. Third-Party Publishers, like Amazon KDP, have content guidelines in place which allow them to turn away customers who are attempting to publish content that is too generic or over-published.

    To quote Amazon KDP’s content quality guidelines:

    “We do not allow content that disappoints our customers or creates a poor shopping experience, including but not limited to:

    • Content that is not significantly different from content in another book available in the Kindle Store.
    • Content that is excessively reused, recycled, or repeated within or across books."

    The above does not refer to plagiarized content, but to content that is too widely discussed or covered in books on similar topics (for example, books on fad diets or current events). 

    It is important that the topic you give your freelancer (in terms of the content that they’re tasked with creating) is sufficiently original and not too akin to other books already published by the Third-Party Publisher you wish to publish with. 

    Our freelancers are not responsible for informing customers if their content is too similar to other books in the same genre or niche, nor is Dibbly | The Urban Writers responsible if a Third-Party Publisher turns you away for not abiding by their content quality guidelines.

    SECTION 9 - THIRD-PARTY AI DETECTION TOOLS

    The use of AI detection tools by third party suppliers does not guarantee accuracy or completeness of any content, and no representation is made as to its accuracy, completeness, or reliability for any content that is produced on the platform, and checked by external AI detectors. The use of AI detection tools by third party suppliers does not constitute the need to revise the content produced. All content produced will follow our conventional revision policies. Our revision policies do not allow requesting changes to the document based on third party AI detection tools used, or based on the speculation of AI tools being used in the content creation process. While these tools may prove useful in certain contexts, they are not always accurate and writers cannot be asked to make changes in accordance with their findings.

    SECTION 10 - PRODUCTS PURCHASED THROUGH OUR MERCH STORE

    Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

    We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

    We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

    We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

    SECTION 11 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

    We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

    You agree to provide current, complete and accurate account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, so that we can complete transactions and contact you as needed.

    We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

    You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

    Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

    We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

    If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

    We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

    You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

    Usage Agreement
    Dibbly | The Urban Writers prides itself on the safe and supportive community it has built for our writers, editors, designers, and our customers. As a user of Dibbly | The Urban Writers project management platform, you, the user agree to:

    • Not share, or request, any personal information with, or from, our freelancers. This includes requests, or sharing, of full name, email, country, address information, or any other request, or sharing, that may be deemed personal.
    • Be respectful and keep conversations professional. Disrespect in any way will not be tolerated.
    • Handle disputes with respect and request admin intervention if needed.

    Termination Disclaimer
    Dibbly | The Urban Writers may terminate access to the project management platform should we find this agreement not adhered to or if we deem a scenario, not mentioned within this agreement, severe enough for termination.

    SECTION 15 - PERSONAL INFORMATION

    Your submission of personal information through the store is governed by our Privacy Policy.

    SECTION 16 - ERRORS, INACCURACIES AND OMISSIONS

    Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

    We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

    We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

    You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

    You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

    In no case shall Dibbly Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

    SECTION 19 - INDEMNIFICATION

    You agree to indemnify, defend and hold harmless Dibbly Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

    SECTION 20 - INDEMNIFICATION FOR FREELANCER ACTIONS

    Dibbly provides a platform that connects users with independent freelancers for content creation and other services. Freelancers are independent contractors and not employees, agents, or representatives of Dibbly. Dibbly makes no representations or warranties whatsoever with respect to Freelancers. By using the Dibbly platform, you agree to indemnify, defend, and hold harmless Dibbly, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in connection with:

    1. Any actions, omissions, or negligence by freelancers engaged through the Dibbly platform.
    2. Any disputes, agreements, or dealings between you and any freelancer, including without limitation any claims related to intellectual property rights, restrictive covenants, work quality, deadlines, or breaches of contract.
    3. Any violation of applicable laws, regulations, or third-party rights by a freelancer, including, but not limited to, intellectual property rights, restrictive covenants and/or any contractual rights, while providing services through the Dibbly platform.

    This indemnification obligation will survive the termination or expiration of these Terms of Service and your use of the Dibbly platform.

    SECTION 21 - SEVERABILITY

    In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

    SECTION 22 - TERMINATION

    The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

    These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

    If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

    SECTION 23 - ENTIRE AGREEMENT

    The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

    These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

    Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

    SECTION 24 - GOVERNING LAW
